The Rehabilitation Act of 1973, Section 504, addresses protections for students with disabilities. Section 504 is a federal civil rights law designed to protect individuals with disabilities from discrimination and ensures access to programs and activities that receive Federal funds. Section 504 requires schools to ensure that students with disabilities have equal access to earn the same result, get the same benefits, and obtain the same level of achievement as their non-disabled peers.

What is the difference between a 504 and an IEP?
Both a 504 and IEP provide accommodations for students with disabilities. However, only an IEP provides specifically designed instruction. Parents, school, and general education teachers should collaborate together to determine which would best meet the needs of the student.

What is considered a disability under Section 504?
Any physical or mental/psychological impairment that impacts one of more major life activities.

Physical impairments can include any physiological disorder or condition, cosmetic disfigurement, or any condition affecting one or more body systems.

Mental impairments or psychological disorders can include intellectual disabilities, organic brain syndrome, emotional or mental illness, or specific learning disabilities.

Major life activities include breathing, walking, talking, hearing, seeing, sleeping, caring for one's self, performing manual tasks, and working.

Some examples of 504 accommodations can include, but not limited to:

  • Preferential or flexible seating 
  • Extended time on assignments and/or tests
  • Access to support personnel (counselor, administrator, etc.)
  • Brain breaks
  • Extra time to transition to classes
  • Checking for understanding
