Dispute Resolution

The VA Regulations in adherence to IDEA provides parents/guardians with a variety of options to address concerns or resolve disputes with their child’s local school division related to disagreements around the special education process. These options include a parent or guardian’s right to address concerns or disputes related to the implementation of special education services and the provision of a free and appropriate public education (FAPE).

The Department of Learning Support-Special Education Services philosophy is that of advocacy for you and your children. Learning Support-Special Education Services is committed to actively locating and identifying any child with a disability eligible for services as part of the division’s Child Find Responsibilities. Department staff are equally committed to collaborating with families and schools to ensure eligible services are implemented effectively in the best interests of students. Parents/guardians are always encouraged to contact school administrators regarding concerns for their child’s education or contact department staff to request assistance in having concerns addressed. We are here to advocate for you!

Special education disputes are better resolved at the local level, if possible. Parents and school administrators are encouraged to work together to come to an understanding of mutual concerns and come to an agreement in the best interest of children with disabilities. The VDOE offers several resolution options for disputes.  Please be reminded that you may seek technical assistance regarding special education as well as file State Complaints, Due Process Complaints, and Mediation via email to ODRAS@doe.virginia.gov. 

Learning Library

The VDOE Office of Dispute Resolution, in partnership with the Center for Implementation and Evaluation of Education Systems at Old Dominion University, has developed the Office of Dispute Resolution Learning Library. This online library provides training videos and resources to aid in understanding special education laws and regulations, as well as strategies to encourage effective collaboration between parents and educators to ensure that school divisions deliver a free appropriate public education to students with disabilities.
